Terms of Service

Your rights, your responsibilities, and what to expect when creating with FocalHue.

At a glance

  • Your media stays yours; you must have permission to use it.
  • Photo and animation saves live in this browser, not a cloud account.
  • Video and selfie work must be downloaded before you leave or reload.
  • Keep backups, check exports, and use editing tools responsibly.
  • Donations are optional and do not guarantee a future update.

This summary is for convenience. The full terms below apply.

1. Who we are & your agreement

FocalHue is a browser-based photo, video, animation and selfie editing service operated by Ron Levi, based in the United States. These Terms of Service apply to your use of the website and its editing tools. Contact: ron@nivinc.com.

Please read these terms before editing. By using FocalHue after being given access to these terms, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the service. These terms do not waive rights that the law does not allow you to waive.

You must have the legal capacity to agree to these terms. If you are a minor under the law where you live, use the service only with a parent or legal guardian’s permission and supervision. If you use FocalHue for an organization, you must have authority to agree on its behalf.

2. What FocalHue provides

FocalHue provides creative tools for importing media, editing photos and layers, retouching and reshaping portraits, arranging video and audio, creating frame animations, and downloading supported outputs. The Help manual describes available tools and tutorials. FocalHue is not affiliated with or endorsed by Adobe, CapCut, BeautyPlus or other editing products.

Current editing tools are available without a required account or payment. Features, file support and performance depend on your browser, device, available memory and storage. We may improve, change or discontinue features. Any future paid offer would need its own clear pricing and applicable terms before you purchase it; these terms do not authorize automatic charges.

3. Your media, ownership & permissions

You retain whatever ownership and rights you already hold in the photos, videos, audio, text and other materials you import, and in your edits, subject to other people’s rights. FocalHue does not claim ownership of your work. Using the tools does not give you rights to someone else’s image, music, logo, font or other protected material.

You are responsible for having the permissions needed to import, edit, copy, download and share your materials, including copyright, music licenses, privacy rights and consent from people depicted where required. Personal and commercial editing are allowed if your use complies with these terms and applicable rights and laws.

You permit the service to process the materials you choose to open as needed to perform your requested editing and export operations. This permission is not a transfer of ownership or permission to publish your media for advertising. Sample artwork and third-party assets are not automatically licensed for every use simply because they appear in the service.

4. Saved work, backups & data loss

Photo and animation projects can be saved in this browser’s local storage database without signing in. These saves are specific to this browser and device; they are not an online account, cloud backup or automatic sync to another device. Anyone with access to this browser profile may be able to open its saved projects.

Clearing site data, using private browsing, changing browsers, storage limits, device failure or browser cleanup can remove saved work. Autosave and undo are conveniences, not guaranteed recovery systems. Save important originals, download finished work and export editable photo/animation backups to a separate location regularly.

Video and selfie work is temporary and is not included in the photo/animation project-saving system. Download it before leaving, reloading or closing the page. An exported image or video is not necessarily an editable project. We cannot recover work that exists only in your browser or guarantee recovery of missing or damaged files.

Only import project backups from sources you trust. Keep a separate copy before restoring or replacing a project. Large files, unsupported formats and malformed backups may be rejected.

5. Local editing, browser storage & external services

The ordinary editing tools process selected media in your browser; they do not require sending your media to a remote editing service. This does not mean visiting the website is anonymous or that no information ever leaves your device. Website delivery, external fonts, infrastructure and error reporting may involve network requests and technical information such as an IP address, browser information or error details.

FocalHue uses browser storage for local projects, autosave, preferences, tutorial choices and session notices. Browser settings let you clear this data, but clearing it may also delete your projects. The device’s camera or file picker is used only when you choose the relevant import or capture action; browser and operating-system permissions and behavior apply.

External links, including Buy me a coffee, take you to separate services governed by their own terms and privacy practices. Contacting us by email shares the information you include with us and email service providers. Do not send sensitive images or project files unless needed and you are comfortable sharing them.

This section explains editing and storage behavior; it is not a complete standalone Privacy Policy or consent to unrelated tracking. Questions about personal information, applicable access or deletion rights, or service-provider processing can be sent to ron@nivinc.com. Deleting browser-local work is done on the device that stores it.

6. Acceptable use

Use FocalHue lawfully and respect other people’s rights. Do not use it to create, process or distribute illegal material; child sexual abuse material; non-consensual intimate imagery; unlawful threats or harassment; fraud; or material that infringes copyright, privacy or other protected rights.

Do not use edits or impersonation to deceive people in ways that cause harm or violate the law. Obtain any consent required for editing and sharing someone’s likeness. You are responsible for how you describe edited media and for disclosures required by law or the platform where you publish it.

Do not attempt unauthorized access, introduce malware, exploit vulnerabilities, disrupt the website, bypass protective controls or use automated traffic that damages service availability. Report suspected security problems privately to ron@nivinc.com. Local editing does not mean we pre-screen or approve your content.

7. Tool results, beta features & exports

Retouching, reshaping, automatic lighting/blending, selections, video point effects and other tools can produce imperfect or unexpected results. Animation joints are beta features. Review your results before relying on them or sharing them. Beauty and reshaping tools are creative effects, not medical advice or a statement about how anyone should look.

Some imports may be resized or converted. Export formats, codecs, resolution, frame rate, transparency and audio support depend on browser capabilities and selected settings. Video recording/export may take real time and can be interrupted. A preview does not guarantee a particular export or exact compatibility with other software. Keep your original files and test downloaded outputs.

8. Optional donations

Buy me a coffee contributions are voluntary support for FocalHue. A donation is not required to edit and does not purchase a promised feature, priority support, an ownership interest or a guaranteed update date. The donation reminder can be dismissed.

Payments take place through Buy me a coffee and its payment providers, not in the editor. Review the amount, currency, whether a payment repeats, and the provider’s terms before confirming. Payment handling, fees, cancellation and refunds are subject to the provider’s processes and applicable law. Contact ron@nivinc.com about a donation issue, and contact the provider for payment-account assistance. We do not represent that contributions are charitable or tax-deductible.

9. Website rights & feedback

The service’s branding, interface and other operator-owned materials remain the property of their respective rights holders. These terms give you permission to use the available service, not ownership of its brand or a license to misrepresent affiliation. Third-party software and assets remain subject to their applicable licenses.

If you voluntarily send suggestions about FocalHue, you allow us to use those suggestions to improve the service without an obligation to pay you or credit you. This does not transfer ownership of media or project files you send, or authorize publication of your private information.

10. Availability & ending use

You may stop using FocalHue at any time. Download or back up your work first. We may restrict access to protect users, address unlawful use or security risks, or comply with legal requirements. We may also suspend or discontinue the service. Where practical, we will provide notice of significant service changes, but emergencies or circumstances outside our control may prevent advance notice.

Stopping access does not delete copies you have downloaded. Browser-local saves remain subject to your browser’s storage behavior; continued access to the site or a future version’s ability to reopen them is not guaranteed.

11. Disclaimers & your legal rights

To the extent permitted by law, FocalHue is provided “as is” and “as available,” without promises that it will always be available, error-free, secure or suitable for a particular purpose. We disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement, only where legally permitted.

Nothing in these terms excludes mandatory consumer guarantees or other rights that cannot legally be excluded. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you.

12. Limits of responsibility

To the extent permitted by law, Ron Levi is not responsible for indirect, incidental, special or consequential losses arising from use of or inability to use FocalHue, including lost profits, interrupted work or loss of browser-local data. You remain responsible for checking your edits, keeping backups and complying with rights and laws when sharing your work.

These limitations do not exclude liability for fraud, intentional misconduct, gross negligence, death or personal injury where exclusion is prohibited, or any other liability that applicable law does not allow us to limit. If local law prevents a limitation, that limitation applies only to the extent allowed.

13. Questions, complaints & disputes

Please contact ron@nivinc.com with questions, complaints, rights concerns or disputes, including enough information for us to understand the issue. Do not include passwords or payment-card details. We encourage resolving concerns through communication, but contacting us does not remove your right to seek a legal remedy.

Applicable United States law governs where legally appropriate, subject to mandatory protections and laws that apply where you live. These terms do not select an exclusive court or state, require arbitration, waive a jury trial or waive participation in a class action. Any dispute must be brought before a court with lawful jurisdiction.

14. Changes & general provisions

We may update these terms as the service or legal requirements change. The effective date on this page identifies the current version. Material changes will be communicated through a visible website notice; where required by law, we will request consent before they apply. Changes do not retroactively remove rights you already have. If you do not agree to an updated version, stop using the service.

If a provision is unenforceable, the remaining provisions continue to apply to the extent allowed by law. A failure to enforce a provision immediately is not a waiver. These terms address use of FocalHue; a separately presented offer or legally required notice may provide additional terms for that specific matter.
